Evictions are a legal process by which a landlord removes occupants from a rented property. The situations where evictions are needed vary widely from case to case.

Some of the most common causes for evicting a tenant include:

  • Rent Delinquency
  • Lease Violation
  • Property Damage
  • Expiration of Lease
  • Illegal or Drug Related Activity

The eviction process is time consuming and can be difficult to manage without experience. That is why having a property management company behind the evictions process can help navigate you through the legal minefield that is involved.

Texas Eviction Laws: Processes and Limitations

In Justice Courts, eviction suits for nonpayment of rent, the parties may represent themselves or be represented by an authorized agent, like an eviction lawyer. Note that in these situations an authorized agent requesting or obtaining a default judgement does not need to be an eviction attorney.

After a Justice of the Peace court judges in favor of the landlord at the hearing, there is a 5 day waiting period before the landlord can take possession of the property. During this time frame, the tenant has the right to file an appeal under limited circumstances. We are unable to represent owners if a tenant successfully files an appeal.
